Payless Plus (https://paylessplus.jp/) operated by Paylessimages Inc. (hereinafter referred to as the “Company") provides photography and video production services (hereinafter referred to as the “Services") for corporations and sole proprietors.

The following Terms of Use (hereinafter referred to as the “Terms") stipulate the terms and conditions for the use of the Services and apply to all relationships between the Company and the users of the Services. Only those who agree to these Terms may use the Services.

1.Terms of Use

These Terms are subject to changes without the consent of the user. The revised Terms of Use shall be effective from the time of publication by the Company.

2.Fees

For small-scale shooting that can be completed by one (1) cameraman, the price listed can be used as a guide. For projects involving more than one staff or large-scale shooting, the Company will provide the estimated fees separately upon request.

3.Calculation of Fees

In the event the user is present at the Company’s studio for shooting purposes, the shooting fee is applicable from the time the user enters into the studio until the end of the shooting. In the event the shooting is carried out at a shooting site or location other than the Company’s studio, the shooting fee is applicable from the time of gathering (entering into the shooting site) until the completion of shooting.

For the avoidance of doubt, the estimated fees as quoted by the Company will be charged even if the shooting time is shorter than planned. However, if the shooting time is longer than planned, an extension fee will be charged.

4.Payment, Cancellation Fee and Postponement Fee

Invoice will be issued after the shooting and kindly transfer the fees as stated in the invoice to the designated account by the end of the month following the shooting month. The bank transfer fees (if applicable) shall be borne by the user. If the user is a sole proprietor, the user is required to make the payment in advance via bank transfer by the day before the shooting.

If the user is engaging the Company for the Services, please contact the Company at least one (1) week in advance before the shooting date in order to make a final confirmation whether to proceed or cancel it. If the final confirmation is not made at least one (1) week in advance, a cancellation fee will be charged based on the following conditions:

・Cancellation after the final confirmation of the shooting date: Hundred percent (100%) of the estimated fee will be charged;
・More than one (1) week before the shooting date: Free of charge;
・Six (6) days to three (3) days prior to the shooting date: Fifty percent (50%) of the estimated fee will be charged;
・Two (2) days prior to the shooting date: Eighty percent (80%) of the estimated fee will be charged; and
・On the day of the shooting date: Hundred percent (100%) of the estimated fee will be charged.

For reschedule due to any reason or weather, a postponement fee will be charged based on the following conditions:
・One (1) week or more before the shooting date: Free of charge;
・Six (6) days to three (3) days prior to the shooting date: Thirty percent (30%) of the estimated fee will be charged;
・Two (2) days prior to the shooting date: Fifty percent (50%) of the estimated fee will be charged; and
・On the day of the shooting date: Hundred percent (100%) of the estimated fee will be charged.

If the studio has been reserved for the shooting, the cancellation/postponement fee may be higher than the above.

5.Method of Delivery

Photos will be delivered in file formats such as jpg, tiff, raw, and videos in mov, mp4, etc., via a storage service or DVD-ROM.

6.Copyright of the Delivered Work

The copyright of the photographs and/or videos taken and produced by the Services belongs to the photographer of the Company who took the photographs and/or videos, unless agreed otherwise with the user. However, this does not limit the user’s right to use the delivered work. Under the management of the user, the delivered work can be freely used within the scope of the predetermined purpose, medium and period of use as agreed.

7.Disclaimer

The Company shall not be liable for any delay or cancellation of the shooting in the event the Company’s staff or the photographer commissioned by the Company are forced to delay or cancel the shooting due to traffic accident or any unforeseen accident on the shooting day itself.

In the event the user caused damages to the Company or any other person due to the performance of the Services, the user shall compensate for the damages at its own responsibility and expenses.

The Company reserves the right to change or suspend any function or feature of the Services without obtaining the prior permission of the user.

8.Jurisdiction

Any dispute arising between the Company and the user shall be submitted to the exclusive jurisdiction of the Tokyo District Court.
